HEALTH GUARANTEE AND CONDITIONS
1. Puppy is guaranteed to be in good health at the time of the sale. All sales are final.
2. Puppy is guaranteed against any life threatening congenital defects one year from date of birth. This includes the following conditions: blindness, liver shunt, or heart murmur. The 1 year health guarantee does not include minor illnesses, hernia, open fontanelle, hypoglycemia, or any internal or external parasites, or anything that can be treated by you or your licensed veterinarian. It does not include anything caused by injury.
3. The puppy is guaranteed for 3 days from time of delivery against any viral disease. The delivery date is as defined in this document the date in which the purchaser or representative of the purchaser takes physical possession of the puppy.
4. The purchaser is required to take the puppy to a licensed veterinarian for a checkup within 48 hours of the delivery date. If the veterinarian should find a life threatening congenital defect, the puppy may be exchanged for another puppy of the same quality and value provided the puppy and its registration papers are returned within 3 business days. All shipping is at the expense of the purchaser. Seller will not drive to get the puppy, except to the Tulsa airport.
5. If the puppy is not taken to a licensed veterinarian within 2 business days, the health guarantee on the puppy is void.
6. If the puppy should die from a suspected congenital defect within 12 months of the date of its birth, proof that the puppy was taken to a licensed veterinarian within the first 48 hours must be provided with a copy of the original exam, a necropsy must be performed at the purchasers expense by a teaching hospital or state licensed DVM, board certified in pathology. If the necropsy shows a congenital defect as the reason for death, the seller will provide another puppy of equal or as close to equal value as possible to the purchaser as soon as one is available. A written statement from the licensed veterinarian, and a complete necropsy report must be provided. The guarantee is void in the event of an indeterminable or inconclusive diagnosis. There will be no replacement puppy for the replacement puppy(no third puppy). No refunds under any circumstances.
7. It is impossible to accurately determine the exact size of any puppy sold, therefore, there is no size guarantee. Size estimates are based on bloodline, parents, and age and size of puppy at the time of sale. No guarantee as to disposition, conformation, or breeding ability will be given. There is no guarantee concerning potty training or any human allergies, or behavioral problems. Once the puppy is delivered the buyer assumes all responsibility for the puppy.
8. The seller is not responsible for any veterinary bills incurred. The seller is not responsible for any shipping fees incurred, and no warranties or guarantees expressed or implied are made under this contract except as stated. Signed or unsigned(by the buyer or seller) this guarantee is valid and is the only one given.
9. This agreement is made and entered in the state of Oklahoma and shall be enforced and interpreted under the laws of this state. If any litigation should arise, it is understood that the seller will get to choose venue and will choose to settle it in the courts of Creek County, Oklahoma.
